There are many surprises in our lives. Some of them are entirely positive and cause no trouble at all, some are negative and some of them are positive, but the surprise packet includes some trouble extra.
As in this example: you have recently rented and moved to a new apartment, but out of blue, there is a gorgeous job offer for you! In a different city, though. You accept the new offer, rent another apartment in the city where you are going to work and… what now? Are you stuck with two rents? Not necessarily, you can sublease the former apartment.
Sublease agreements (other names: Sublease Contract, Sublet Agreement, Sublet Contract, Room Rental Agreement, Apartment Sublease Agreement, Residential Sublease Agreement) are written when you decide to sublet: a house, an apartment, a bedroom or a commercial property (here it is a Commercial Sublease).
However, remember that before making any decisions about subletting your apartment, you must contact your landlord first or read your lease really thoroughly. If you breach the lease by subletting the apartment, you can have problems. Certainly, you do not need them so, in the very beginning, it is better to make sure whether you are allowed to rent the place “further”.
Even if the lease initially does not allow for subletting, it is not a lost cause yet. You can still negotiate and ask your landlord for amendments. There is always a chance that he will not have any objections.
Is it always necessary to sign the sublease agreement?
When it comes to our friends or family, we are usually more willing to make agreements using just a word and a handshake. Of course, if the potential subletters are people that we can trust, we do not worry that they can have an idea to intentionally put the place on fire.
Though, remember that not everything must be done intentionally. Accidents happen and in such situations it is really convenient to have everything in writing. Anticipating and thinking in advance is a very useful habit in this case. Everyone knows who is responsible for what and you can avoid unnecessary and stressful conflicts, arguing and court.
What significant should the sublease agreement include?
In general, maintenance of the place is mainly on the landlord’s side. But, it concerns serious repairs, like problems with broken devices or pipes. The everyday maintenance – such as keeping the place tidy or mowing the lawn – lies on the tenant’s side.
Therefore, it will be very helpful if you have clearly established whose responsibility is this or that. In this way you will avoid misunderstandings and conflicts. When it comes to any alterations in the rented place, it is always a good idea to disallow making any big changes in the place you sublet.
